TERMS OF SERVICE

By commissioning any works from me, the artist, you agree to the following terms of service.

PAYMENT:

Commissions must be paid in full upfront, whether before or after the preliminary sketch. Acceptable currency for payment is USD. Any discussion of price without explicit mention of currency is implied to be in USD. Payment is only accepted through PayPal.

PROCESS:

The time to completion of the artwork is subject to change at any point due to factors including but not limited to: Health, Family Matters, Order of commission, Complexity, Work, School.
Work in Progress updates are provided under the artist's discretion.

COPYRIGHT/USAGE:

The artist holds all rights to the artworks commissioned, not the commissioner.

The artist reserves the right to;

• Advertise their work using any works commissioned.
• Display their work through any outlet they please.

The commissioner reserves the right to;

• Use the artwork for personal use.
• Print the art.
• Claim the ownership of their character(s), but not the overall work.
• Use the art for personal promotion with credit to the artist.

The following are considered copyright infringement and a commissioner doing so will forfeit any rights provided toward commissioned works laid out in these terms;

• Reproduction of the commissioned work for commercial purposes.
• Removal of any marks identifying the artist of a commissioned work.
• Any means of exploiting the commissioned work for commercial or financial purposes (ex. NFT, resale, etc.)
• Claiming to be the creator of any commissioned work.
• Alteration or modification of the commissioned work in any way without the artist's written consent.

Purchase of commercial rights to a commissioned work will incur a 200% surcharge of the original commission price.

With commercial rights, the commissioner may;

• Use the commissioned work for merchandise or other sellable goods using depictions of the commissioned work
• Modify the work as they please
• Credit is still required, even if the work is in any way modified.

CANCELLING/REFUND POLICY:

The artist reserves the right to cancel and refund any commission at any time under their discretion.
The commissioner reserved the right to demand a refund or cancel a commission up to the point at which work begins on the commission, including a preliminary sketch.

Any statement in these terms of service are subject to change under the artist's discretion with agreement from the commissioner before work begins on a commissioned work.
